In A Fabricated Case on Which He Was Already Acquitted
Cairo, 11/3/2010
The Arabic Network for Human Rights Information said that the Ministry of interior is still insisting on defying the law and justice in attempt to put the famous blogger Wael Abbas in prison.
Wael was surprised to find a new sentence issued against him in the same fabricated case on which he was acquitted a few weeks ago after it was proven to be fabricated. He found himself facing the same sentence; 6 months in prison and a bail of LE 500 for "providing telecommunications service to the public without permission from the authorities!" This charge had already been dropped by the public prosecution in a previous case about "vandalizing an internet connection". Abbas and ANHRI defense team were surprised to learn about the new sentence in this case that has already been closed.
This new sentence, which was issued in through a rather twisted legal path, reveals an invisible hand manipulating the case, disregarded the prosecution decision to rule out the charge and forwarded the case to the Economic Court as a fresh case to be looked into again resulting in issuing a prison sentence. ANHRI defense team did not find a trace of this charge in any relevant prosecution documentation.
Gamal Eid, the Executive Director of the Arabic Network for Human Rights Information said "this is a blatant tampering with the law manifested in the continuous games played by the Ministry of Interior. The case was closed already and Abbas was acquitted after proving to the judiciary that it was a completely fabricated. We are surprised by this new and rather quick sentence and a campaign by the security authorities with the aim to imprison Wael Abbas. Despite having more than ten million court decisions not been implemented in Egypt, the Ministry of Interior is so keen to jail blogger that it regards with great hostility. This is because his blog exposes crimes of torture and corruption in Egypt. No state ever mobilizes all its security forces to take revenge from a young man but the Egyptian state".
The Arabic Network has decided not only to pursue legal defense for Abbas, but also to sue the citizen, behind whom the Ministry of Interior is hiding (this citizen also happens to be a police officer's brother) for issuing a false communiqué. This is especially true after the court has discovered the whole case was fabricated and acquitted Abbas.
Gamal Eid said, "We are expecting some answers from the Attorney General's office. They started the proceedings of the fabricated case against Wael Abbas on which he was acquitted. We wonder how the prosecution will act this time when we file a communiqué against the citizen whom the Ministry of Interior uses as a cover for all these illegal proceedings."

قالت الشبكة العربية لمعلومات حقوق الإنسان اليوم، أن وزارة الداخلية ما زالت تمارس تحديها للقانون وعبثها بالعدالة ، لمحاولة الزج بالمدون المعروف وائل عباس في السجن ، حيث فوجئ عباس بصدور حكم جديد ضده في نفس القضية الملفقة التي صدر الحكم فيها منذ أسابيع قليلة بالبراءة لثبوت واقعة التلفيق ضده ، بنفس الحكم "حبس ستة أشهر وكفالة 500جنيه لوقف التنفيذ" ولكن باتهام جديد هو تقديم "خدمة اتصالات للجمهور بدون ترخيص من الجهات المختصة ! " ، وهي التهمة التي سبق وأن استبعدتها النيابة العامة في القضية السابقة "إتلاف وصلة سلك إنترنت" ، ليفاجأ المدون ومحاموه بالشبكة العربية بصدور حكم جديد في هذه القضية التي سبق الحكم فيها فعليا من قبل.
ويفضح هذا الحكم الجديد الذي صدر بغير الطريق الذي رسمه القانون " حيث اكتشف محاميي وحدة الدعم القانوني لحرية التعبير بالشبكة العربية أنه ليس له اثر في الأوراق الخاصة بالنيابة العامة " أن هناك يد خفية حركت القضية وأهدرت قرار النيابة العامة بعدم الاعتداد بها ، حيث أوصلت هذه اليد الخفية الأوراق للمحكمة الاقتصادية كقضية جديدة ، ليصدر حكم جديد بالحبس فيها.
وقال جمال عيد مدير الشبكة العربية لمعلومات حقوق الإنسان" هناك عبث وإستهتار شديد بالقانون تكشفه ألاعيب وزارة الداخلية يوما بعد يوم بتلفيق هذه القضايا ، فنحن أمام قضية سبق الحكم فيها ، وتم تبرئه المدون بعد كشف التلفيق ، لنفاجأ بحكم جديد وسريع ، وحملة أمنية تستهدف سجن المدون وائل عباس ، ورغم ما يزيد عن عشرة ملايين حكم قضائي لم ينفذ في مصر، تنشط وزارة الداخلية لتنفيذ حكم بالحبس ضد مدون تكن له عداء شديد ، فقط بسبب مدونته التي يفضح فيها جرائم التعذيب والفساد في مصر ، ليس هناك دولة تحشد كل قوتها الأمنية للانتقام من شاب سوى مصر".
وقد قررت الشبكة العربية ألا تكتفي بموقف المدافع القانوني عن المدون فقط ، بل قررت أن ترفع قضية" بلاغ كاذب" ضد المواطن الذي تتخفى خلفه وزارة الداخلية وهو شقيق أحد ضباط الشرطة ، لاسيما وأن المحكمة قد كشفت عن تلفيق القضية التي رفعها ضد وائل عباس ، وحكمت بالبراءة.
وقال جمال عيد" سوف ننتظر موقف النيابة العامة التي حركت القضية الملفقة ضد وائل عباس وتم الحكم فيها بالبراءة ، وماذا ستفعل حين تكون القضية هذه المرة ضد مواطن تستخدمه وزارة الداخلية كواجهة لهذه القضايا التي لا تمت للقانون بصلة.

بصراحة انا مش هقدر اقول اكثر من اني اوجه قصيدة للحمار الكبير
وده احدى القصائد اللي كتبتهاوهذه القصيدة تصف الحالة التي وصلنا لها وحسبنا الله ونعم الوكيل في هذه الحكومة الضالة المضلة وهذا الحزب الوثني البيروقراطي مثلما اسميه
يلي بنيت قصرك من دم الغلابه الفقارى المساكين
طوبه بنتها دهب وطوبه بنتها فضه وكله فل وياسمين
وعشان تعيش يا حضرة جنابك شردت شعبك بالملايين
شعبك التعيس البائس اليائس المحطم المعذب الحزين
لكن لما صرخ الشعب وقال فين فلوسنا يا شلة مأجورين
كتمت صوته وهزمته يا حضرة جنابك وقتلت فيه الحنين
ويعيني على الغلابه كالتهم الديابة لما كانوا في حالهم قاعدين

في متل بيقول "وراك وراك والزمن طويل"..
في ظل هكذا حكومة "حسني باشا" مسرحيات مبتذلة كهذه لا تبعث إلا على الضحك المثير للبكاء..
عمل المحاكم عادةً يتمثل في إظهار الحقيقة والكشف عنها لإحقاق الحق ودفع الظلم.. هذه رسالة القضاة بشكل عام..
لكن في مثل هذه القضية تكون الحقيقة غالباً "واضحة" والجميع يعلمها جيداً.. لكن المسرحية تستمر لأن أحدهم يرغب بمشاهدة هذه المسرحية ويستمتع بسخرية..
أشد على يديك وائل.. بحرارة..

مطار القاهره الجديد تحفه فنيه وايه من ايات الجمال لدرجة اننا اثناء عبور هذا المكان اتهيا لى اننا تهنا وخرجنا برا حدود مصر اعذرونى اصل انا من بيئه شعبيه ومش واخده ع الدلع ده المهم لما اتاكدت اننا ما تهناش ولا حاجه وان احنا على ارض مصر دمعت عيناى وشعرت بغصه والم لما افتكرت باقى احياء وشوارع مصر الغرقانه فى المجارى والاهمال وتذكرت حديث الرسول صلى الله عليه وسلم يد القاسم فى النار الا ان عدلت .. مش عارفه مدى صحة الحديث لكن المهم انه المفروض ان من لا يعدل يجب ان يحرق فى النار ..يعنى يا ولاد اللذين نطبطب على طياز ناس وندلعهم بالقوى ونمد ايدينا ونسرق شقا الغلابه ونذلهم بفرض الضرايب عشان ندلع ناس مش محتاجه

أنا عندي إقتراح، إيه رأيكم بدل الكلام الهبل ده بتاع أن كامب ديفيد والواد أمريكا الشرير هما سبب كل البلاوي اللي في مصر زي البلهارسيا اللي في جتة المصريين من أيام الفراعنة، إيه رأيكم نعمل وقفة إحتجاجية على الترع والكباري، ولو شفنا أي واحد بيشخ في الترعة وبيشرب شخته نخصيه هو واللي جابوا أمه، وبعد كده نطلع على القرى والمراكز اللي بتجيب الأشكال الوسخة اللي بتحكم البلد ونحرقها من جدورها ونبدأ بقرية كفر البعبوص، مركز ميت ناكة، محافظة الخرابية، وبعدين ننقل على اللي أوسخ منها اللي هي كفر المصيلحة، محافظة المنوفية

اخوانى و اخواتى ااهالى سمالوط الكرام
الى كل الجهات الرقابيه و غير الرقابيه الى كل الرجال و النساء الى كل الاطفال و الشيوخ الى كل من لم تمت ضمائرهم الى كل من يتمنى غدا افضل افيقوا و اقرؤا المهازل التاليه
كثرت فى الاونه الاخيره عاده سيئه و هى صدور العديد من المنشورات المزوره و المنسوبه للصحافى المحترم المعارض حماده عمار الهدف منها النيل من سمعه ابناء و رموز سمالوط الشرفاء وخلف هذه المنشورات مجموعه واحده من الافراد معدومى السمعه والاخلاق و الذمه و الضمير و ذلك لخدمه اهوائهم و مصالحهم الشخصيه وذلك بعد نشره و فضحه للنائب علاء مكادى عضو مجلس الشعب عن الحزب الوطنى للاسف و مساعده المقدم احمد الجعلى ضابط امن الدوله سى السمعه بالمنيا للاسف ايضا و يتم ذلك فى مطبعه سريه فى منزل احد افراد عصابتهم
البدايه كانت عندما نشر الصحفى الشريف الشاب حماده عمار بعض و اكرر بعض تجاوزات نائب الصدفه و مساعده ضابط الشرطه مثل
- سرقه اموال الفقراءللعلاج على نفقه الدوله ( 100 مليون جنيه كما نشر فى جريدة الاهرام و المصرى اليوم )
و النائب علاء اعلن عن علاجه لاكثر من 25000 حاله فى اربع سنوات اى 6250 حاله فى السنه اى 520 حاله فى الشهر اى 130 حاله اسبوعيا اى 26 حاله يوميا بدون انقطاع او اجازات او عطلات هل يعقل هذا العدد و اين هم انا شخصيا تعرضت لاكثر من موقف معك ولم احصل على اى شى يا حلو اللسان
- الاستيلاء على اراضى الدوله شرق النيل و بيعها بملايين الجنيهات
- الحصول على ملايين الجنيهات رشوه من من المستثمر الذى انشاء مصنع الاسمنت (تم القبض على هدا المستثمر فى بنى سويف فى قضيه مشابه و اعترف برشوه الحج علاء مكادى) لتسهيل الاجراءت و الموافقات المختلفه
- الاستيلاء على الاف الافدنه امام قريه سبعه بطريق مصر اسيوط الصحراوى الغربى
- التسبب فى الفتنه الطائفيه و تغذيتها من اجل مصالحهم الشخصيه و السياسيه
- الاستيلاء على الاموال و المنح و القروض الممنوحه لجمعيه حقوق الانسان لحسابهم الشخصى
- تحميل حسابات جمعيه حقوق الانسان بجميع مصاريف النائب و صديقه الشخصيه مثل فواتير الطعام فى الفنادق الخمسه نجوم و فواتير التليفون المنزليه و المحمول
- استغلال مقر و املاك جمعيه حقوق الانسان فى العمل السياسى
- استغلال خطة الدوله و نسبها لانجازات النائب المزيفه مثل محطة المياه و محطة الصرف و كبرى النيل واشاعته هو اعوانه تم تعين الالاف من ابناء سمالوط وها انا ام اعين رغم تقدمى بطلب له اكثر من خمس مرات وغيرهم الكثيرالكثير و الكثير
- تورط علاء مكادى و احمد الجعلى فى قضية غش الثانويه العامه المشهوره بالمنيا
- الغش فى وزن المواد الغذائيه التى تعباء للتموين عن طريق احد افراد عصابتهم
- الاتجار فى الاسلحه الاليه من خلال احمد الجعلى و عضو مجلس محلى سىء السمعه
- الاستيلاء على المنحة المقدمه من الحزب لمساعدة الفقراء من ابناء الدائره لسداد ديون النائب الخاصه بقضاياه المختلفه
- التدخل السافر فى المحليات مما نتج عنه هذا المجلس الهش الفاشل بعد استبعاد رموز و اعيان و نشطاء البلاد و الزج ببعض المسجلين خطر و اصحاب السوابق و الخارجيين عن القانون و تجار السلاح
- احتكار رجالهم فى الرقابه الشعبيه (شباب مبارك) توزيع انابيب البوتجاز مما ساعد على تفاقم الازمه
- التهديد المستمر من رجالهم للافراد البسطاء بالاعتقال
- بيع تاشيرات الحج
- الحكم على النائب و افراد عائلته المشبوهين بالسجن فى الكثير من قضايا الشيكات و وصولات الامانه
- الضغط على العديد من الشباب البسيط رقيق الحال حتى يتم استقطابهم للعمل كمرشديين سياسيين عن طريق الترهيب و الترغيب لصالح النائب علاء مكادى عن طريق المقدم احمد الجعلى
- بناء مرسى على النيل بدون تصاريح
- الاستيلاء على اراضى املاك الدوله و بناء اسوار عليها بغرض ضمها لاملاكه الخاصه بعد طمس معالمها

- و هناك الكثير و الكثير الذى يحتاج الى مجلدات و اخيرا و ليس اخرا مقتل الفتاه المسيحيه الفقيره بالقطوشه بالرصاص على يد احد شباب كبار العائلات بعد اغتصابها و تدخل النائب علاء و المقدم احمد و حصلوا على 120000 جنيه لانفسهم كاتعاب و فدان ارض و 600 الف جنيه لاهل القتيله لتغير اقوالهم بعد افتضاح الامر و تم تحويل طبيب الوحده للنيابه العامه حيث انه قد اثبت من قبل ان الوفاه طبيعيه
وعندما علم الحج علاء عزم الحزب الوطنى استبعاده من ترشيحات انتخابات مجلس الشعب 2010 لانه سىء السمعه و لا امل له مع الحزب هاله الخبر و فقد الكثير من وزنه و سرت الاشاعات عن اصابته بالسكر و البعض قال انه مرض عضال وا سرع لمساعده و ساعده الايمن صديق عمره المقدم احمد الجعلى و على الفور وضع الخطه و اصدر التوجيهات لتنفيدها
اولا: التخلص من الصحفى الشاب النزيه المعارض
- عن طريق بعض الاعوان المقربيين و احد اقارب علاء مكادى لتهديده فى الشارع و ضربه و باءت المحاوله بالفشل
- عن طريق رسائل تهديد تليفونيه له و لزوجته وا طفاله الصغار
- التهديد بالقتل عدة مرات
ثانيا: زعزعة ثقتنا نحن اهالى سمالوط فيما يكتبه حماده عمار عن طريق طباعة و توزيع منشورات مزوره لتبعد النظر عن مخالفات علاء مكادى و احمد الجعلى و عصابتهم تسب الشرفاء من رموز العائلات و البلاد مثل الساده : نجيب الشريعى – محسن السيد – جابر الخولى – وحيد عامر- نبيل خضر- صباح – و المرحوم الشهيد اللواء حميده عبد العاطى – سماح ابو الليل – رجب عبد الحكيم
و الهدف الاساسى هو الحط من قدر هذه العائلات التى نجلها و نحترمها و تطمح لكرسى الفئات فى انتخابات 2010 و هو يعلم تماما انه خاسر لا محاله امامهم ( سامح ابو الليل – حسن السيد – سعد عبد العاطى )
ولكن بأت كل هده المحاولات بالفشل
ثالثا:تلفيق القضايا و التهم المختلفه لكثر شوكة هذا الرجل الشريف
رابعا: تكثيف الدعايه و يفط الشكر و المجاملات باسماء افراد لا يعلمون شى عنها و اصدار السيد المحافظ تعليمات بازالتها الفوريه اكثر من سبعة مرات و عمل محضر لاحد اتباعه يدعى وائل مظهر
و هناك الكثير و الكثير من التجاوزات ولكننى لن اخوض فى الاعراض حرصا منى على عدم اشعال الفتنه و خلى الطابق مستور و السؤال هو يا سيادة النائب و يا سيادة المقدم من اين لكم بكل هذا الا تشبعون ام انكم استصغطم طعم الاموال الحرام سيارات فارهه وعمارات شاهقه بالقاهره و شقق بالقاهره و فيلل فاخره بالساحل الشمالى والشركات متعددة الانشطه و الحسابات المختلفه بالبنوك و الكثير الا يقدم احمد الجعلى و علاء مكادى اقرارات ضريبيه و اقرارات ذمه ماليه ام انهم فوق القانون
و لا يخفى على احد انه تم اكثر من مره فى الشهور الاخيره تحقيقات و يتم حاليا تحقيقات مع علاء مكادى و مساعده احمد الجعلى و عصابتهم فى كل الجهات الرقابيه فى سريه تامه
و فى النهايه ادعوا عائلتى اهالى سمالوط ان يفيقوا و ينتفضوا و يتخلصوا من هولاء النصابين و سى السمعه وان يطهروا البلد من امثالهم
